1. The short version
TrainAtlas is a personal rail log for iPhone. By installing or using it you agree to these terms and to our Privacy Policy. If you bought a Pro subscription, your purchase is handled by Apple under their standard subscription terms. Realtime delay data comes from third-party operators, so it can be wrong; we do our best to surface it accurately but we cannot guarantee any specific train will run on time.
2. Who we are
These terms are between you and the operator of the TrainAtlas iOS app (bundle ID app.trainatlas.ios) and the trainatlas.app website. References to "we," "us," and "our" refer to that operator. Contact details are in section 13.
3. Your license to use TrainAtlas
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use TrainAtlas on any Apple device you own or control, for non-commercial personal use. The app itself remains our property; this license does not transfer ownership.
Your use is also governed by Apple's standard Licensed Application End User License Agreement ("Standard EULA"). Where the Standard EULA differs from these terms, the Standard EULA applies for terms that Apple requires.
4. Subscriptions and one-time purchases
The core TrainAtlas experience is free. Some features (collectively, "Pro") require a subscription or one-time purchase, handled entirely by Apple's StoreKit:
- Monthly: $2.99 per month (auto-renewing). Billed to your Apple ID.
- Yearly: $14.99 per year, with a 7-day free trial for new subscribers (auto-renewing).
- Lifetime: $24.99 one-time purchase. No recurring charge. Includes all current and future Pro features for the lifetime of the app.
Prices shown above are in US dollars; equivalent local-tier prices apply in other App Store regions. The price displayed inside the app at purchase time is authoritative.
How auto-renewal works
- Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before the renewal date.
- Renewal is charged to the payment method linked to your Apple ID, at the then-current price for your subscription tier.
- You can manage or cancel at any time in Settings -> [Your Name] -> Subscriptions on iOS, or via the App Store.
- If you cancel during the free trial, you will not be charged. The trial converts to a paid subscription if not cancelled at least 24 hours before it ends.
Refunds
Refund decisions are made by Apple under their refund policy, not by us. Submit refund requests at reportaproblem.apple.com. If Apple refunds your purchase, we will revoke the corresponding Pro entitlement.
5. Acceptable use
You agree not to:
- Reverse-engineer, decompile, or disassemble the app beyond what applicable law allows.
- Use the app or its data feeds to build a competing commercial product or to resell timetable / delay data.
- Probe, scan, or stress-test our backend or the third-party data sources we rely on (please contact us if you want bulk access).
- Use the app in any way that violates applicable law or interferes with another user's enjoyment of the service.
6. Third-party data
TrainAtlas surfaces realtime delays, platforms, and schedule data from public rail-operator APIs (Deutsche Bahn, SNCF, Trenitalia, SNCB, NS, Renfe, ÖBB, SBB, Trafikverket, VR, Vy, Iarnród Éireann, Eurostar, Realtime Trains UK, and others) and from open-data feeds (proxy.transport.data.gouv.fr, GTFS-RT, etc.). We do not own this data and we do not control its accuracy.
Train arrival times, platforms, cancellations, and other realtime information are provided "as is" and may be inaccurate, incomplete, delayed, or unavailable. Do not rely solely on TrainAtlas for time-critical travel decisions. Always confirm with the operator's official channels before committing to a connection.
7. Your content
Trip data you enter into TrainAtlas (routes, notes, stations, etc.) remains your own. We have no access to it - per our Privacy Policy, this data lives on your device and (if you enable iCloud sync) in your personal Apple iCloud container. You are responsible for keeping backups; we cannot recover trip data that is lost due to device failure, iCloud issues outside our control, or accidental deletion.
8. Disclaimers
TrainAtlas is provided "as is" and "as available," without warranty of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that defects will be corrected.
The app is a personal travel-log tool and is not a substitute for a transport operator's official information channels.
9. Limitation of liability
To the maximum extent permitted by applicable law:
- We will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, missed connections, or substitute service costs, arising out of your use of (or inability to use) the app.
- Our total cumulative liability for any direct damages will not exceed the greater of (a) the total amount you have paid us for the app in the twelve months preceding the claim, or (b) US$50.
- This limitation applies whether the claim arises from contract, tort, statute, or any other legal theory.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
10. Termination
You can stop using TrainAtlas at any time by deleting the app from your device. If you have an active subscription, see section 4 for cancellation.
We may suspend or terminate your access to the app if you materially breach these terms, if we are required to do so by law, or if we discontinue the service. If we terminate without cause, we will refund any prepaid amounts on a pro-rata basis through Apple.
11. Changes to these terms
We may update these terms from time to time. Material changes (anything that meaningfully reduces your rights or changes pricing) will be announced via the effective date at the top of this page and, where practical, in the app. Continued use of the app after a change means you accept the updated terms. If you do not accept a change, you can cancel any subscription and stop using the app.
12. Governing law
These terms are governed by the laws of Portugal, without regard to its conflict-of-law principles. Disputes arising out of or relating to these terms will be brought exclusively in the competent courts of Portugal, subject to mandatory consumer-protection laws in your country of residence that may grant you additional rights.
If you are a consumer in the European Union, you may also have access to alternative dispute resolution via the EU Online Dispute Resolution platform.
13. Severability and entire agreement
If any provision of these terms is held to be unenforceable, the remaining provisions will continue in full force and effect, and the unenforceable provision will be enforced to the maximum extent permitted by law. These terms, together with the Privacy Policy and Apple's Standard EULA, are the entire agreement between you and us regarding TrainAtlas, and they supersede any prior agreements.
